NCIL INFORMATION ALERT: Recent Developments in Advocacy for Home And Community Based Services
This is the first in a series of three alerts on Medicaid and Home and Community Based Services and supports issues that NCIL will issue this week. We are currently in the midst of a very tough legislative environment in which there are very real concerns that policymakers may sacrifice the best interests of beneficiaries to meet arbitrary targets as a part of the approaching budget reconciliation process. Despite this challenging outlook, we have an opportunity to possibly achieve policy breakthroughs in expanding access to home and community-based Services for persons.
This first alert will advise you of the latest developments on legislation that NCIL currently supports involving home and community based services. Next, we will send you a call to action, asking you to take specific steps to send your Senators and Representative the message that Congress needs to ACT NOW to take concrete steps to expand the availability of Home and Community Based Services for persons with disabilities. Finally, we will ask you to contact your elected officials to urge them not to make changes to Medicaid that would go against the best interests of beneficiaries – such as increased cost-sharing or diminished protections of beneficiaries’ rights.
MiCASSA [H 910/ S 401] and Money Follows the Person
[H 3063/ S 528] Gain Momentum in Congress.
Though we are still well short of the 105 MiCASSA sponsors that we had in the House by the end of the 108th Congress, NCIL is pleased to report that H 910 has picked up 20 sponsors over the past month alone! This brings the total number of MiCASSA sponsors in the House to 48. New cosponsors include Republicans Sherwood Boehlert [NY-24], James Walsh [NY-25] and Jerry Moran [KS-1], Independent Bernard Sanders [VT], and sixteen Democratic members. The sixteen new Democratic co-sponsors include Edolphus Towns [NY-10], Tom Lantos [CA-12], Lynn Woolsey [CA-6], Harold Ford Jr. [TN-9], Collin Peterson [MN-7], Louise Slaughter [NY-28], Luis Guttierez [IL-4], Rahm Emanuel [IL-5], Peter Visclosky [IN-1], Mark Udall [CO-2], Neil Abercrombie [HI-1], Brad Miller [NC-13] as well as Health Subcommittee members, Tammy Baldwin [WI-2], Gene Green [TX-29], Anna Eshoo [CA-14] and Diana DeGette [CO-1]. Since June, the total number of sponsors of S 401, the Senate version of MiCASSA, has remained unchanged at 15 – five less than MiCASSA had during the 108th Congress.
In the last month, H 3063, the House version of Money Follows the Person, has also gained momentum, picking up seven additional sponsors, including Thaddeus McCotter [R, MI-11], who became the first House Republican to officially endorse Money Follows the Person. The other six new sponsors are Independent Bernard Sanders [VT] and Democrats Anna Eshoo [CA-14], Tom Lantos [CA-12], Michael Capuano [MA-8], Silvestre Reyes [TX-16] and Peter Visclosky [IN-1]. This is the first Congress in which Money Follows the Person has been introduced in the House. The number of Senate sponsors for Money Follows the Person [S 528] has stayed unchanged at 7 since mid-July. During the 108th Congress, Money Follows the Person had 11 sponsors. See below and attached for the complete lists of sponsors for MiCASSA and Money Follows, as well as lists of who sponsored these bills during the 108th Congress.
NCIL endorses new proposal, Section 201 of S 1602, to make Home and Community Based Services available without waiver.
On July 29, 2005, just before Congress started August recess, Senators Charles Grassley (R-IA), Hillary Clinton (D-NY) and Evan Bayh (D-IN) introduced S 1602, the “Improving Long-Term Care Choices Act of 2005,” a bipartisan bill designed to promote home and community based services and make long-term care insurance more affordable. NCIL supports Section 201 of the bill, which would provide states with a new option to offer home and community based services to Medicaid-eligible individuals without having to get a federal waiver. States would also be able to permit people to choose to self-direct services. Under the self-direction model, states would be required to establish more rigorous eligibility standards for institutionalization than for placement in community settings. In his statement introducing the bill Senator Grassley explained,"…[T]he legislation I am introducing today compliments rather than supplants my efforts to enact Family Opportunity Act and Money Follows the Person. I believe we should provide a wide range of options to the states to encourage them to identify and eliminate barriers to community living including access to consumer direction and respite care."
After careful study, NCIL’s Health Care-Personal Assistance Services and Support Subcommittee submitted a letter in support of Section 201 of S 1602 late last month. Please find this letter below and attached. We welcome the provisions of Section 201 of the “Improving Long-Term Care Choices Act of 2005,” which are clearly consistent with NCIL’s legislative goals as well as the clear statement that Chairman Grassley is striving to enact Money Follows the Person.

Dear Senator Grassley:
On behalf of the Health Care/ Personal Assistance Services and Supports Subcommittee and the membership of the National Council on Independent Living, we are writing to express our support for Section 201 of S 1602, the “Improving Long Term Care Choices Act.” We thank you for your leadership in introducing this provision, which represents a proactive bipartisan initiative to expand the range of options for the delivery of long-term care services.
We support Section 201 because it contains the following provisions:
- States may offer home and community based services without obtaining a waiver from HHS;
- States could allow consumers to self direct their care. Under the self-direction model, states would be required to establish more rigorous eligibility standards for institutionalization than for placement in community settings – removing the traditional institutional bias;
- States may offer home and community based care to individuals not currently eligible based on income, limited to those with incomes up to 300 % of SSI income and meeting the resource requirements;
In introducing S 1602, you said, “the legislation I am introducing today compliments rather than supplants my efforts to enact Family Opportunity Act and Money Follows the Person.” We welcome the provisions of Section 201 of the “Improving Long-Term Care Choices Act of 2005,” as well as your continued commitment to passing Money Follows the Person.
